Terms of Service

These terms explain the rules for using LightHeart, how trial and subscription access work, and the limits and responsibilities that apply to the service.

These Terms of Service govern your access to and use of LightHeart, including the mobile app, related web interfaces, and connected features. By creating an account, starting a trial, making a purchase, or otherwise using LightHeart, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use LightHeart.

1. What LightHeart is

LightHeart is an emotional wellbeing product centered on reflective conversation, journaling, stories, voice capture, AI-assisted transcription and analysis, and memory continuity over time.

LightHeart is operated by Ferruccio Nati.

2. Eligibility and age-related use

You may use LightHeart only if you are legally capable of accepting these Terms in your jurisdiction. If local law requires parental or guardian consent, supervision, or authorization, that requirement must be satisfied before use.

3. Account creation and security

You may create or access a LightHeart account using Google, Apple, or email/password, depending on availability in your region and device context. You are responsible for maintaining the confidentiality of your credentials and for activity under your account.

Information you provide must be accurate and not misleading. You must not impersonate another person or access another user's account without authorization.

4. Trial, subscriptions, billing, cancellation, and refunds

LightHeart currently offers a 3-day free trial. After the trial period ends, paid access is required for premium features.

Prices can vary by country, currency, taxes, and storefront. The price shown to you in the applicable purchase flow at checkout is the price that applies.

If you purchase auto-renewing access, renewal occurs automatically unless canceled before renewal under your store or purchase channel rules. You are responsible for managing cancellation timing in the applicable store account settings.

Billing, renewal notices, payment handling, and refund processing may be controlled by Apple, Google, or another authorized payment channel. Refund eligibility is determined by the policies of the purchase channel and any mandatory law that applies to you.

If you use LightHeart on iOS, your app license and certain purchase rights are also governed by Apple's Standard End User License Agreement (EULA) and Apple Media Services Terms and Conditions: Apple Standard EULA and Apple Media Services Terms.

5. Acceptable use

You agree not to:

  • use LightHeart for unlawful, abusive, deceptive, or harmful conduct;
  • interfere with the security, stability, or availability of the service;
  • attempt to reverse engineer, scrape, automate, or exploit the service beyond what LightHeart expressly allows;
  • upload or submit content that you do not have the right to provide;
  • use LightHeart to harass, threaten, manipulate, or invade another person's privacy.

6. Your content and the license required to operate LightHeart

As between you and LightHeart, you retain your rights in content you submit, such as chats, stories, journal text, audio, and edits.

By using LightHeart, you grant the operator and service providers supporting LightHeart a limited, non-exclusive license to host, store, reproduce, transcribe, analyze, format, process, and display your content only as needed to operate the service, provide memory continuity, improve reliability, keep the service secure, and respond to your requests.

7. AI and wellbeing disclaimer

LightHeart uses AI-assisted features. AI-generated responses, transcriptions, summaries, memory suggestions, or reflections may be incomplete, inaccurate, delayed, or inappropriate for your situation. You remain responsible for how you interpret and use AI output.

LightHeart is not a medical, psychiatric, psychological, therapy, or crisis service and does not replace professional care. LightHeart does not diagnose, treat, cure, or prevent medical or mental health conditions and must not be used as an emergency service. If you may be in danger or need urgent help, contact local emergency services immediately.

8. Third-party services and processors

LightHeart depends on third-party infrastructure for account, purchases, notifications, AI processing, hosting, storage, and related functionality. Those services may have their own terms and privacy rules, and LightHeart is not responsible for obligations that are solely theirs.

9. Availability, updates, and feature access

LightHeart may modify, suspend, improve, or remove features from time to time. We do not guarantee every feature will always be available on every device, platform, language, or country.

Certain features may require active paid entitlement, permissions such as microphone or notifications, and compatible runtime support.

10. Account suspension and termination

You may stop using LightHeart at any time and, where available, request account deletion through the app.

LightHeart may suspend or terminate access where reasonably necessary for violations of these Terms, fraud or abuse prevention, legal compliance, or security protection of users and infrastructure.

11. Intellectual property

The LightHeart service, software, interface, branding, design, documentation, and related materials are owned by or licensed to Ferruccio Nati and protected by applicable intellectual property laws. These Terms do not transfer ownership of the service itself to you.

12. Disclaimer of warranties

To the maximum extent allowed by law, LightHeart is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We do not guarantee uninterrupted availability, perfect accuracy, or that the service will meet every expectation or outcome.

13. Limitation of liability

To the maximum extent permitted by law, LightHeart and Ferruccio Nati are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the service.

Where liability cannot be excluded entirely, total aggregate liability is limited to the amount you paid to LightHeart for the relevant service during the 12 months before the event giving rise to the claim.

14. Governing law, venue, and mandatory consumer rights

Unless mandatory local consumer law requires otherwise, these Terms are governed by the laws of Italy, without regard to conflict-of-law rules.

Subject to mandatory law, disputes related to these Terms are handled by the courts with jurisdiction under applicable law. If you are a consumer, you may also have rights to bring claims in your country of residence where those rights cannot be waived.

Nothing in these Terms excludes or limits mandatory rights you may have under applicable consumer protection law in your country of residence, including non-waivable rights and remedies.

15. Changes to these Terms

LightHeart may update these Terms from time to time. If this occurs, the updated version will be posted with a revised effective date and, where appropriate, additional in-app or email notice.
